Terms & Conditions

These Terms & Conditions ("Terms") govern your use of MyBrandPilot (the "Service"), operated by Joseph L Bess II ("we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

1. The Service

MyBrandPilot is an AI-powered marketing strategy platform. It crawls public information about your website, runs AI agents to analyze SEO, content, ads, email, and conversion performance, and produces an evidence-based marketing strategy with a 12-month roadmap.

2. Acceptance

By continuing to use the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts & Credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it current.

4. Acceptable Use

You agree not to misuse the Service. Specifically, you will not:

  • Use the Service for any unlawful purpose or to violate any applicable law or regulation;
  • Engage in fraud, spam, or phishing;
  • Infringe on the intellectual property or privacy rights of others;
  • Attempt to gain unauthorized access, probe for vulnerabilities, upload malware, or scrape the Service;
  • Use the Service to crawl or analyze sites you do not own or have permission to analyze;
  • Resell, redistribute, or provide the Service to third parties without written consent.

5. AI-Generated Outputs

The Service uses generative AI to produce recommendations, strategy reports, and other outputs. You are responsible for:

  • Reviewing outputs for accuracy before acting on them;
  • Ensuring you have the rights to any content or URLs you submit as input;
  • The consequences of implementing any recommendations.

Outputs may be inaccurate, incomplete, or unsuitable for a specific use case. The Service is not a substitute for professional marketing, legal, financial, or other advice.

You must not use the Service to generate content that is illegal, harmful, hateful, deceptive (including deepfakes), or that constitutes harassment. We reserve the right to filter, moderate, remove, or refuse outputs, and to suspend accounts that misuse the Service.

6. Intellectual Property

We retain all right, title, and interest in the Service, including the underlying software, documentation, branding, and any improvements. You retain ownership of the input content and prompts you submit; we retain the right to use them solely to operate and improve the Service.

7. Payment & Subscriptions

Paid plans are billed on a recurring basis (monthly or as otherwise selected). All order processing, billing, tax, and payment support is provided by our reseller as described below. Subscriptions renew automatically until canceled. You can cancel from within the Service or by contacting our reseller.

8. Reseller & Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Service Level

We work hard to keep the Service available and performing well, but we do not guarantee that the Service will be uninterrupted, error-free, or that specific results will be achieved. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension & Termination

We may suspend or terminate your access to the Service without liability for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious violations of our acceptable use policy. On termination, your access ends; you may request an export of your data within 30 days.

11. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the six (6) months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, gross negligence, death, or personal injury where such limitation is prohibited by law.

12. Indemnity

You agree to indemnify and hold us harmless from claims arising from your input content, your use of the Service in violation of these Terms, or any unlawful use.

13. Changes

We may update these Terms from time to time. Material changes will be notified via the Service or email. Continued use after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Joseph L Bess II is domiciled, without regard to its conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless applicable law requires otherwise.
